Assessment Review Board - Emergency Order (O.Reg.73/20) and Board Updates
Attached is a copy of a letter received from the ARB concerning timelines under the Emergency Order. While the order suspends the time limits affecting cases that can be or are currently being heard by the tribunals, it also grants the tribunals the flexibility to enforce the normal time limits in certain cases but that will be on an individual basis.
Below is a summary prepared for City of Ottawa staff that may be of some assistance. Please be sure to read the memo in its entirety for your own interpretation.
- Schedule of Events Suspended - The Schedule of Events timelines will be suspended until April 30, 2020 at which time the Board will review to determine if the suspension should continue. As of May 1st, the Board expects all parties to resume their schedule of events as of the week when the emergency order took effect.
- Deadline to File Appeals extended to 15 days after the Emergency Order has been lifted - The Board states they still expect the majority of appeals to be filed by the March 31, 2020 deadline, as filing is done electronically. However, they are allowing an extension of 15 days after the lifting of the Emergency Order.
- Requests to Dismiss for failure to serve an SOI will only be considered if they were filed before March 1, 2020.
- Requests for Review, Request for Late Appeal, and Deeming of appeals will all proceed in accordance with the Board’s Rules.
- Hearing Events – All hearing that are currently scheduled by teleconference or written format will proceed. Any new hearings will be scheduled after May 19, 2020.

School Board Remittances
Over $1.8 billion by deferring the upcoming school board remittances:
June 30th due September 30th
September 30th due December 15th
December 15th due December 15
This provides municipalities the flexibility to, in turn, provide property tax deferrals to residents and businesses, while ensuring school boards continue to receive their funding.
